Since being called to the Bar in 2021, Kendal has established a wide practice spanning all areas of soft IP and media law. She has a particular expertise in trade marks and passing off, copyright, designs and database rights, in addition to related contractual and jurisdictional issues. Kendal conducted her first solo IPEC trial just 3 months after taking tenancy against experienced senior counsel. Since then, she has appeared regularly as both sole and junior counsel in the IPEC, High Court, Court of Appeal, UKIPO, and before the Appointed Person.
Kendal has acted in some widely reported cases, including AGA v Uk Innovation [2024] and WaterRower v Liking [2024], which was awarded Impact Case of the Year at the Managing IP Awards 2025. She is also an ADR qualified mediator and a contributor to Copinger and Skone James on Copyright.
Outside of Chambers, Kendal teaches on the trade mark litigation course at Nottingham Law School, and she also sits on the committee of IPSoc. Before coming to the Bar, Kendal spent some time working in the Copyright and Enforcement Directorate at the UKIPO. As part of the Digital Technologies Team, her work was focused on the interaction between Artificial Intelligence and IP law, and the shifting legal landscape in this area.
Kendal graduated from the University of Oxford with a distinction on the BCL. During her time at Oxford, she specialised in IP and Computer Science. She also has a first class law degree from Queen Mary University of London, where she received various awards including the Roger Crane Medal for outstanding academic performance. During her undergraduate studies, she spent a year on exchange at the University of Hong Kong. She received a full scholarship from Lincoln’s Inn for the Bar course and was also a residential scholar of the Inn.
Trade Marks & Passing Off
Morley’s (Fast Foods) v Nanthakumar & Ors [2025] EWCA Civ 186 – Led by Simon Malynicz KC, Kendal acted for the Appellants in the appeal brought on the grounds that (inter alia) the trial judge had erred both in her assessment of the average consumer and of the pre-existing settlement agreement between the parties. Kendal made oral submissions before the Court of Appeal in relation to the eighth ground of appeal.
Makeality v City Doggo [2024] – Kendal represented the Claimant at the CMC in these proceedings for trade mark infringement and passing off in relation to the “Piddle Patch” brand. The decision at the CMC to transfer the proceedings to the IPEC small claims track, despite the Claimant contending that the matter was not suitable for the SCT due to its financial value and complexity, was appealed to the Court of Appeal.
AGA Rangemaster v Uk Innovations [2024] EWHC 1727 (IPEC) – Kendal acted for the successful Defendants in this trial for trade mark and copyright infringement in relation to the advertising and sale of retrofitted AGA cookers on the second-hand resale market. She was led by Simon Malynicz KC. Whilst the Defendants’ products themselves were held not to infringe, the way in which the Defendants had advertised their products was held to infringe. This part of the decision is subject to appeal.
Morley’s (Fast Foods) v Nanthakumar & Ors [2024] EWHC 1369 (IPEC) – Kendal appeared as sole counsel for the Metro’s Defendants in this trial for trade mark infringement and breach of contract brought by the popular chicken shop brand “Morley’s”. The finding of infringement by the Defendants was appealed to the Court of Appeal.
Insight Out Entertainment v Bram Schrooyen (P/K/A Phase) [2024] – Kendal represented the Defendant, a well-known music producer and DJ operating under the name ‘Phase’, in proceedings to strike out a claim for passing off and breach of a settlement agreement brought by a rock band also known as “Phase”.
Anora Group v Valhalla York (O/0022/25) – Kendal acted successfully for Anora Group in these consolidated opposition and cancellation proceedings relating to various 2D and 3D marks for “VALHALLA”.
Apex.AI v Hangzhou Mengshi Technology (Awaiting decision) – Kendal acted for the Opponent, Apex.AI, in its trade mark opposition brought against the word mark “APEX”.
Moving Life v BYD Company (Awaiting decision) – Kendal acted for the Respondent, BYD, in defending a trade mark opposition brought by Moving Life in relation to the mark “ATTO”.
BHS Trans v Flo Water (O/1086/24) – Kendal acted successfully for BHS Trans in its cancellation application on non-use grounds against the mark “FLOWATER”.
Pet US v Primeur (O/0866/24) – Kendal acted for Pet US in these consolidated opposition and cancellation proceedings relating to the marks “MIGHTY PAW” and “MIGHTY PAWS”.
Amy Jones v Learning Resources (O/0635/24) – Kendal acted for Amy Jones in these consolidated opposition and cancellation proceedings relating to various word and figurative marks for “LEARNING RESOURCES”.
Barking Brains v Pet Food (O/0060/24) – Kendal acted successfully for Barking Brains in defending a trade mark opposition brought by Pet Food in relation to the mark “Barking Brains”.
McDonalds v Jana Speleers (Awaiting decision) – Kendal acted for Jana Speleers in these consolidated opposition and cancellation proceedings relating to the marks “LOVIN IT”, “LIVIN IT & LOVIN IT” and “I’M LOVIN’ IT”.
Net World Sports v EPC Alternative Source (O/1165/23) – Kendal acted successfully for Net World Sports in defending a trade mark opposition brought by EPC Alternative Source in relation to the mark “FORZA”.
Indian Motorcycle v Indian Motorcycles (O/1119/23) – Kendal acted successfully for Indian Motorcycles in its trade mark opposition against the figurative mark for “Indian Motorcycle 1901”.
Hilife Music v Hilife Music Entertainment (O/0482/23) – Kendal acted successfully for Hilife Music in defending decision O/1066/22, relating to the cancellation of various marks for “Hilife Music”, on appeal to the Appointed Person.
X Cyber Group v Panda Security (O/0126/23) – Kendal acted successfully for X Cyber Group in defending a trade mark opposition brought by Panda Security in relation to a series of marks for “Pandora’s Box”.
Giorgio Armani v Martin Orena (O/0119/23) – Kendal acted successfully for Martin Orena in defending a trade mark opposition brought by Giorgio Armani in relation to various figurative eagle marks associated with the “Digital Money” brand.
Beebaltic v Marius Kumpelis (O/0113/23) – Kendal acted for Marius Kumpelis in his appeal to the Appointed Person of decision O/501/22, in relation to figurative and word marks for “Baltic Honey”.
Arnage Motors v Jaguar Land Rover (O/1091/22) – Kendal acted for Arnage Motors in a trade mark opposition brought by Jaguar Land Rover in relation to the mark “CarJager”.
Copyright & Design Rights
Tipping v Smith [2025] – Kendal represented the Claimant at the CMC and the hearing of the Claimant’s application for strike out and/or summary judgment in these proceedings for infringement of copyright in various “Max Power Magazine” photographs.
Walden v Kaymans Apparel [2024] – Kendal represented the Waldens at the CMC in this claim for infringement of copyright and breach of confidential information in respect of the Claimants’ private wedding photographs.
WaterRower v Liking (t/a Topiom) [2024] EWHC 2806 (IPEC) – Kendal acted for the successful Defendant in this trial for infringement of copyright in the “WaterRower”, a wooden water-resistant rowing machine. She was led by Jonathan Moss. In one of the most significant IP decisions of recent times, it was held that the WaterRower did not qualify as a work of artistic craftsmanship, and thus there was no copyright infringement.
Fay Evans v John Lewis & DDB [2023] EWHC 766 (IPEC) – Kendal appeared as sole counsel for the Claimant in her copyright infringement trial against John Lewis over its infamous 2019 Christmas Advert, “Excitable Edgar”. The Defendants contended that they had independently created the storyline for the Christmas Advert prior to the release of the Claimant’s book.
WaterRower v Liking (t/a Topiom) [2022] EHWC 2084 (IPEC) – Led by Jonathan Moss, Kendal acted for the Defendant in proceedings to strike out a claim for infringement of copyright in a wooden water-resistant rowing machine known as the “WaterRower”.
Equisafety v Ollard Westcombe [2022] – Kendal represented the Defendant in an allocation and relief from sanctions hearing in proceedings for the infringement of unregistered design rights in a horse blanket.
